TERMS AND CONDITIONS FOR SALES AND DELIVERY
General
The following terms and conditions for sales and delivery are in reference to the sale of products from Kyoto Trade AB to its customers. It is the customer’s responsibility to stay informed about these terms and conditions. By placing an order, the customer also approves the terms and conditions for sales and delivery. For more information, see the Consumer Purchases Act. Information can be found on the web site for the Swedish Consumer Agency (konsumentverket).
Agreement
The sales agreement between Kyoto Trade AB and the customer is established first when Kyoto Trade accepts the customer’s order in the form of an order confirmation, also received by the customer. Kyoto Trade reserves the right for eventual typos and necessary pricing adjustments due to events beyond Kyoto Trade’s control.
Delivery
Delivery takes place from the current Kyoto Trade depot within five working days form the order placement. In the case that the product is not in stock, the delivery will made as soon as possible. It is the customer’s responsibility to check the product directly after delivery. Eventual transportation defects should be immediately reported and signed on the delivery invoice. Hidden defects should be reported with a written notification to the shipping company within seven days of the delivery. If the customer has picked the product up directly from the shipping company’s depot, defects should be reported to the shipping company’s nearest depot. The product’s wrapping should be available for inspection upon request. In the case that the customer has not returned the product in the afore mentioned manner and within the right time frame then the right to compensation due to shipping defects expires.
Payment
For payments made by companies outside of Sweden, only credit card or pre-payment are accepted.
 
Kyoto Trade accepts VISA, MasterCard and Eurocard. Kyoto Trade uses the 3 D safety standard to assure secure Internet payments.
It is the customer’s responsibility to provide Kyoto Trade with a valid credit card number. The customer thereby accepts that the order sum will be reserved from the customer’s bank account ten days from the order date. The order sum is lifted from the customer’s account upon delivery of the product from Kyoto Trade’s depot.
With payment upon delivery where the order sum exceeds 10 000 SEK including shipping fees, the customer should possess a money order for the total sum including shipping fees. The money order should be written to Posten Sverige AB and is given to the shipping company upon delivery.
In the case that the customer does not accept the product upon delivery and does not pick the product up from the shipping company’s depot within 14 days, the purchase will be cancelled and Kyoto Trade will withhold the right to charge the customer a double shipping fee as well as 10% of the order sum. With credit card payment this means that the debited amount minus double shipping fees and 10% of the order sum will be returned to the customer’s account. The same rule is applicable for pre-paid orders, wherein the customer will receive a cash return. If the customer has chosen to pay upon delivery, Kyoto Trade withholds the right to subsequently bill the customer a double shipping fee plus 10% of the order sum.
If failure of delivery occurs due to circumstances related to Kyoto Trade, the purchase is cancelled and the pre-paid fees are returned to the customer.
Kyoto Trade withholds the right of ownership for products until payment is received in full.
Disputes
Disputes in reference to this purchase shall ultimately be settled by arbitration in accordance with the Rules for Expedited Arbitration by the Arbitration Institute of the Stockholm Chamber of Commerce. Kyoto Trade withholds the right to choose to, without delay, demand overdue payments in a qualified court of law.
